The legitimacy of the Public Defender's Office in the protection of collective rights

The aim of this article is to analyze the Federal Supreme Court's understanding of the legitimacy of the Public Defender's Office for the protection of collective rights, especially in light of the judgment on Theme 607 and ADI 3.943. Despite the appreciation of precedents, new cases still come before the Court and demand a response from the Supreme Court on the content of its own decision. In this context, these new cases were analyzed in order to gain a clearer understanding of the Supreme Court's decision-making standard, i.e. in which cases does the Public Defender's Office have legitimacy to act (or not) and what interests are at stake? In addition, we will find out which defender's offices are most involved in seeking action from the Supreme Court to assert their legitimacy.
