Abstract

This article, inspired by the attendance to the people who seek for the Public Defender’s Office, intends to discuss language problems considered relevant to Law, focusing on the theory of concepts. For this purpose, we develop the basic conception that Law carries inherent problems of language, mainly due to two issues: the need to conceptualize reality - which brings within it a discussion about the "truth" itself, under Nietzsche's perspective - and what Waismann called "open texture of empirical concepts". At the end of the study, we analyze the essentiality of the judge’s to cover the linguistic gaps inherent in law.
