Abstract

The implementation of custody hearings (also known as a presentation hearing) represented a major advance in terms of the necessary control of police violence commonly practiced against marginalized social zones. In 2015, the STF, in a historic judgment, recognizing that the prison system passes through the State of Unconstitutional Things, determined the immediate holding of custody hearings across the country, in order to mitigate the over-incarceration and also in an attempt to remove unnecessary arrests. Thus, the Public Defender's Office not only followed this advance, but also shows itself as an essential institution in the control of police violence and unnecessary provisional arrests, especially in times of the COVID-19 pandemic.
